Welcome to www.antaratma.in, herein referred to as the “Site” or “website”, a property of Antaratma Lifestyle Private Limited, a registered company under the Companies Act, 2013 with registered office at 152, Thekkumthala, East Kadungalloor, Aluva, Ernakulam district, Kerala, India, 683102. “Antaratma” is a trademarked brand under Antaratma Lifestyle Private Limited, which is in the business of selling premium lifestyle retail products, and in the business of tour operations in India and abroad.

Throughout the site, the terms “we”, “us” and “our” refer to both Antaratma, the brand, and Antaratma Lifestyle Private Limited, and are/could be used interchangeably as and when needed. Antaratma Lifestyle Private Limited offers this website, including all information, tools and services available from this site to You (“You” or “End User” or “Your” or “Buyer” or “Customer”), conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable. The amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record does not require any physical or digital signatures. Notwithstanding anything contained or said in any other document, if there is a conflict between the terms mentioned herein below and any other document, the terms contained in the present Terms and Conditions shall alone prevail for the purposes of usage of this website.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

The price of our products as mentioned on the Website is the Maximum Retail Price (MRP) for the said product. These are inclusive of all local taxes as are applicable in India and we reserve the right to include additional applicable taxes depending on the destination where the order has to be shipped to. The Pricing is subject to our pricing policy and the prices shall be determined only at our sole discretion.

Prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. Antaratma reserves the right to collect taxes and/or levy/duty/surcharge that it may have to incur in addition to the normal taxes it may have to pay. We may also charge delivery charges which may include postal charges/shipment charges etc. applicable to your country.

We shall not be liable to You or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

 

SECTION 5 - PRODUCTS OR SERVICES (if applicable) 

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

COLOURS

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

 We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

CANCELLATIONS BY US

There could arise some circumstances – limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or any defect regarding the quality of the product – where We may have to cancel Your order. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. We may also require additional verifications or information before accepting any order. We will get in touch if all or any portion of your order is cancelled or if any additional information is required.

If Your order is cancelled after the credit card/ debit card/ any other mode of payment has been charged, the full amount will be reversed to Your Account / as the case may be to the source of the payment within a period of 30 working days. Any type of voucher used in these orders shall be returned and made available to the User in case of a cancellation by us.

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SHIPPING AND DELIVERY

Our shipping charges and processing fee are intended to compensate Antaratma for the cost of processing Your order, handling and packing the products You purchase and delivering them to you. Please see our Shipping policy here.

We strive to fulfil, to the best of our abilities, all the orders but we do not guarantee delivery of products in the stipulated time period as mentioned on the purchase of the product. In no manner can the contract be repudiated if Antaratma fails to deliver any one or more products in the said time frame. If you fail to take the delivery of the goods, however, we may, at our sole discretion, charge you for additional shipping cost.

 

SECTION 7 - OPTIONAL TOOLS 

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. 

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

Users may not modify, publish, transmit, participate in the transfer or sale, creative derivative works, or in any way exploit any of the content, in whole or in part. Users may download/ print/ save copyrighted material for personal use only. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express permission of Antaratma and the copyright owner is permitted.

If copying, redistribution or publication of copyrighted material is permitted, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The User acknowledges that he/she/it does not acquire any ownership rights by downloading copyrighted material. Trademarks that are located within or on the Site or a website otherwise owned or operated in conjunction with Antaratma shall not be deemed to be in the public domain but rather the exclusive property of Antaratma Lifestyle Private Limited, unless such site is under license from the trademark owner thereof in which case such license is for the exclusive benefit and use of Antaratma, unless otherwise stated.

While availing any of the payment method(s) offered by us, we are not responsible or take no liability whatsoever w.r.t any loss or damage arising directly or indirectly to you including but not limited to the following: (a) lack of authorisation for any transaction(s); (b) or exceeding the present limit mutually agreed by you and between your “Bank(s)”; (c) or any payment issues arising out of the transaction; (d) or decline of transaction for any other reason(s).
All payments made against the purchases /services on the website by You shall be as against the MRP displayed on the website and shall be in terms and conditions of the third-party Online Payment Gateway Services as adopted and applicable to your transaction as approved by us. Before shipping your order to you, we may request you to provide supporting documents (including but not limited to Govt. Issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done so as to ensure a safe and a full proof online shopping environment to our users.

Antaratma may employ Razorpay, PayU, Paytm, Gpay, PaisaPay, PayPal and such other third-party facilities, for Payments on the Website. Such payments can be made through the electronic mode or through Cash on delivery transactions, as may be permitted by Antaratma, which shall be at its sole discretion. Use of such third-party services will be governed by their User Agreement, Seller Terms, Conditions and other rules and policies as may be required and applicable for your nature of activities.

 

SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. 

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

In no case shall Antaratma Lifestyle Private Limited, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

When you use the Website or send emails or other data, information or communication to us, you agree and understand that You are communicating with us through electronic records and You consent to receive communications from us periodically and as when required. We will communicate with You by email or by an electronic record on our Website which will be deemed adequate service of notice/ electronic record.

 

SECTION 21 - GIFT CARDS

Gift cards can be redeemed only on our website, and cannot be used to purchase other gift cards. If the order value exceeds the Gift Card amount, the balance must be paid by any other mode of payment made available to You.

Please note that the Gift Cards expire after six months from the date of issue and any corresponding unused balance shall be forfeited thereafter. Validity of these Gift cards cannot be extended and new ones cannot be provided against unused/expired gift cards. Gift cards cannot be redeemed for Cash or Credit either. 

The Gift card number is confidential. You are solely responsible for the safety and security of these. In the event of any misuse of Gift card due to loss of any such confidential details due to the fault of the customer, Antaratma shall not be responsible for the same and no refund can be issued.

Please understand that Gift cards are a Prepaid Instrument subject to regulations by the Reserve Bank of India. Antaratma will be legally required to share the details of the purchase of Gift cards and/or transactions undertaken using the Gift Card with RBI or such statutory authorities. 

There is no fee or other charges associated with gift card purchases.

 

SECTION 22 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service or the documents of third-party payment channels, and any separate agreements whereby We provide You Services shall be governed by and construed in accordance with the laws of India. Your obligations to pay the Payment Fees shall not be suspended during the pendency of any legal proceedings.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
